I to have been trying to get a loan modification from indymac or owb since march 2009. I lost my job and my home is worth less than I owe.
I've tried everything from sending documents 4 and 5 times over the year, filed a complaint with Thrift, contacted HUD counselar, and they still tell me to refile my paper work. this seems to be a game with them to keep you sending them paper work and never intending to do anything.
and why should they? when they are not going to lose a dime over our mortgages. they will actually make money by forclosing and cashing in on the sale of your home and FDIC
backing there lose, if they sell for less than you owe.
by the way my investor is fannie mae,
what is really ironic is one of the owners of one west is also the owner of Dell computors which is what I am writing this comment on.
I know as a independent I have no leverage,and probably will never see a modification.
but I hope that I get to see when justice prevails on these money worshiping morons.

As of 5pm today. I am no longer the owner of my home. WHY?? I had a short sale agreement.. (been under contract since 11/09)... HOWEVER, since the loan was orginally thru IndyMac.. OWB & Indy both have to sign off on the package. Well they did... Onewest was sending it out overnight.. However, the URGENT cover page got lost somewhere between Indymac getting it and sending it... SO the package will be here at 10am in the morning.. but we only had til 5pm TODAY to close... Tried to talk to them and they said we had plenty of time to take care of this... WHAT??!!?? How can you take care of something when we are waiting on THEM???!!!???? So Thanks to someone losing the URGENT coverpage... My house will now be foreclosed on... THANKS INDY & OWB....

Take a look at Kern County Superior Court Case No. 268473 Maya vs IndyMac, OneWest Bank. They foreclosed even though there was a current forebearance agreement, then rescinded the Trustees Deed then tried to forclose again. Stopped them cold for now though

I hane been dealinmg with indymac bank now for 3 moths now. and have recieved nothing but headaches, frustration, extreme anger, and utter distain for anyone associated with this poor excuse for a company. From the outset, (as I am miticulous with all my dealings with all banks, because I know that by and large they are all life sucking lowlives), I made it a point to send them the correct documentation. would'n you knoe, they got some of my documents but not others(which were all sent together and stapled.). T date, these pieces of filth have lost(or so they claim) two complete sets of documents, and two fax transmissions which cost me $12 each. It seem all too covenient and to this company's benefit to loose as much of your documentation as possible in order to delay the process for those who need help. In this way, they can drag their feet in the number of modifications which they are mandated to restructure by the federal government. Those of you who have been in this process for more than 8 months need to contact indymac and question why it is taking so long.

After reading all these comments, I realize I am not alone. Almost one year of sending documents, no answers, no replies. Brandon Latman VP of One West is useless, all he is good for is sending out form letters, "are you experiencing mortgage problems, we are here to help"! THen you contact him, and IndyMac, and no one is there to help, or answer you.
everyone involved with IndyMac should stop paying their mortgages and stick it up their asses. This is a disgrace in this country, that we are not being protected.

owb are liars, i have sent the same paperwork over and over, certified mail, fax, upload, they say they have it,then on my loan mod portal one day later same thing I uploaded is missing, 4 months in the making for this crap

Wow I thought we was the only one, I'm self employed and live in Miami Florida....I'm fighting with owb on a daily basis trying to get a loan modification, it has been about 8 months now and still trying... I too have fax them all my paperwork numerious times and always the same answer over and over, they never recieved it or it's processing, I hope this nightmare ends real soon...I just got serve our foreclosure papers from the attorney office....I too will fight to the end....

ive worked for many banks, and many different positions in those banks... do you think u would be able to make a decision on changing someones loan without the investors approval? i mean they put up the money. Why would the servicer for the investor have say over the investor? i have been thru foreclosure. i knew it was because i had a private investor who wouldnt participate in mods. i got screwed. so i feel the pain.. but we pick ourselves back up as americans and move on!!!

I am dealing with the same situation for over a year now. I have filed a complaint with the Office of Thrift Supervision the other day.
ALSO, anyone out there that lives in Massachusetts, I came across this group the other day that is putting together a class action lawsuit in Massachusetts against four major banks (OneWest/IndyMac, JP Morgan Chase, Bank of America and Wells Fargo).
Contact them and join the lawsuit to help put a stop to what these banks are doing.

Same as you all...Major run around for 18 months now. County Sheriff sticks notices of auction on property gates when there is a mailbox 3 feet away ON the gate! So much for confidentiality and respect!!!
5 mofif packages later, 2 CBS interviews and numerous nightmares, and stress-induced sicknesses, I am barely hanging on. We need to be all together in action. REVOLUTION ANYONE? Our communities are dying, gangs and 3rd world families are taking over, because the standard of living in the USA is not taught or enforced. Yet , OWB employees told me last year that I could not sell to family or friends and it was too bad I spent too much on my monthly payment! The HAMP program said so...Well, how many fortunes were made in the US because of many generations living under one roof, eating simply and focusing on the long term hard work for success? Do not tell me how to live: it is the basis of the American Dream the country is feeding us daily!!!Freedom, ever heard of it? I am a hard working American who chose this country to live-not born here- Now that the 5% of the population who have everything want more, we are supposed to walk away from our hard earned properties, and are told they are "worth' nothing anyway...Thus meaning our lives are worth nothing?
Uh, correct me if I am wrong, but how much more do THEY want? It is not a matter of Right or Left, Blue or Red , but a human right: how would THEY react if we all lived in the streets, below their windows? Would the "deport us to China"??? I thought this was the U S of A, not the U S S R... Com'on y'all: Let's march! I know millions of Californians are ready!

It is OUTRAGEOUS that we have to opt OUT of havingour banking info shared with "affiliates" and "non-affiliates" for marketing purposes.
We should have to opt IN for One West to use us as marketing guinea pigs.

In my opinion IndyMac is massively disorganized. The following is only a small portion of what I have been through with them.I have been working on a loan modification for 8 months now. I have been asked to submit documentation over and over again. It gets lost over and over again. The review process is supposedly 30-60 days. By the time they review your paperwork the financials are out of date, and they will ask you to submit paperwork again, which they will most likely lose. The other day I was give 3 fax numbers to send in more lost paperwork. One by a letter. One by the auto attendant when I called. And one by the representative on the phone. So I faxed to all 3. Then I sent via FedEx. Then I called after the prescribed 48-72 hours to confirm that it was in the system. I spoke to a representative who is not able to confirm that they have everything needed to process the loan modification. Now it must wait to be reviewed by a verification specialist who will get to it when they can. Maybe another 30-60 days? All I can say is be persistent and patient. Hopefully it works out for you.

Gosh it seems like there are so many horror stories out there. I was thinking of calling OWB but now I am not so sure. I would suggest people also connect on facebook to help try and spread the word more. FB is onewestfail.

My husband and I have been trying to get a modificaton for the last year, the run around is all we have gotten. We tried to do a refi with them but at the last minute they came up with apprasial of half of what the county said. But, I think that is good.
Finally, there is a Class Action suit out of Illinois. OWB settled the suit and I believe that they did this because......they really don't have a contract with us.
Even though we allowed our original note with Indy Mac to be transfered, where is the good faith in the contract that allows it to be from one bankrupt bank to a new invented one like OWB. Where is the meeting of the minds required in a contract? Would the stealing of the deposits of Indy Mac Bank depositors be "public policy" in order to be enforceable?
The FDIC sold the assets of Indy Mac Bank 6 months after its bankrupdsy to OWB. The assets of IMB were worth 32 billion dollars at that time. In January of 2009 OWB closed on these assets for 1.5 billion. The FDIC paid off the depositor to the tune of 50 cents on the dollar.
The FDIC sold the IMB assets to OWB in bulk, those assets were sold as is, where is, to OWB with no promises or guarantees.
So, when was the last time a contract for cars, trucks, livestock or Haitian orphans could be sold in bulk? Especially homes?
Your not getting my home OWB. Man up Lawyers!!
