My husband and I have been trying to get a modificaton for the last year, the run around is all we have gotten. We tried to do a refi with them but at the last minute they came up with apprasial of half of what the county said. But, I think that is good.

Finally, there is a Class Action suit out of Illinois. OWB settled the suit and I believe that they did this because......they really don't have a contract with us.

Even though we allowed our original note with Indy Mac to be transfered, where is the good faith in the contract that allows it to be from one bankrupt bank to a new invented one like OWB. Where is the meeting of the minds required in a contract? Would the stealing of the deposits of Indy Mac Bank depositors be "public policy" in order to be enforceable?

The FDIC sold the assets of Indy Mac Bank 6 months after its bankrupdsy to OWB. The assets of IMB were worth 32 billion dollars at that time. In January of 2009 OWB closed on these assets for 1.5 billion. The FDIC paid off the depositor to the tune of 50 cents on the dollar.

The FDIC sold the IMB assets to OWB in bulk, those assets were sold as is, where is, to OWB with no promises or guarantees.

So, when was the last time a contract for cars, trucks, livestock or Haitian orphans could be sold in bulk? Especially homes?

Your not getting my home OWB. Man up Lawyers!!

I've sold 30+ REO's for OWB without any of the issues described on this blog. I've also represented plenty of those looking for a short sale on a IMB/OWB property too.

Bad packaging of the offer is the real reason most short sales are not approved.

Bad packaging of a modification is the real reason most are not approved.

Why are people/borrowers pissed off that OWB and the investors are profiting instead of the taxpayers debt servicing their lifestyle.

Take some personal responsibility and move to a property you can afford. People have grown to live way beyond their paycheck.

60% of the issues are created by the fact most people never should have received the loan in the first place.

Does not a modification into a 2% interest rate only prolongs the losses and adds to taxpayers potential loss/costs?

I went into foreclosure (72K in arrears) in 11/07 and just got out in 2/10. No modification, no reduction of principle, just a simple repayment plan. I signed a contract and honored it to my best ability.

I would expect others to do the same.

I sell foreclosed homes for the turds at Indy. Just the other day I read an article spelling out the fraud they and the FDIC have committed against the borrowers. They don't modify, they don't, "work it out", they are simply in it for a profit. A big profit. One West was created only to take over the assests of Indy at a reduced fee. 70% on first mortgages and 58% on seconds. They have guarantees from FDIC to protect their losses. So we are all led to believe that they are loosing big time and actually they make big bucks on foreclosed homes. You get screwed twice becasue your tax dollars are funding the bastards at FDIC to pay the idiots at OWB. And guess what? They are going to get away with it. Obama is going to get away with it and business as usual. Your best revenge is to live well. Don't pay taxes, sue the OWB's to the end, they will settle with you so they are not exposed any further. Don't give up, find an attorney that will show the lies in court.

I am actually a would be buyer of a small cabin that was forclosed on and the title is evidently held by OneWest. The house has been sitting vacant for over 6 months. The real estate agent cannot even get a confirmation that they got an offer. This agent who sent them a purchase offer is the official listing agent. I guess this is not the first time this has happened. The buyers just end up walking away after not hearing a peep from OneWest for weeks. Glad these banks are getting their acts together after all the billions we gave them.

My name is Robert Patrick-Seligman, I am married and am now facing the loss of our home. Please, listen to my story and learn that we do not have to wallow in embarrassment but instead, take action against our mortgage giants that are determined to take our homes for their personal gain.

I met my wife approximately 3 years ago and since we both had homes, hers in Eagan and mine in Minneapolis, we needed to consolidate and live in the most affordable, space available and the location best for everyone. At the time, we chose Eagan. It was a smaller home but had a payment we could afford and with our now large family, we could make do. During this time, my home in Minneapolis (a duplex) was up for sale.

It was on a warm summer evening when we opened our mail. In the mail was a 35 page document from our mortgagor, Indy Mac. This package contained everything that could make our lives change and unfortunately, not for the best. This package called a “loan modification” was sent to us, we didn’t inquire, we didn’t ask, it was sent to us out of the blue. In this loan modification, Indy Mac promised to reduce our loan payment on my home(duplex) in Minneapolis by $600.00, it would be crazy to pass up on the opportunity to take over the duplex and sell the house in Eagan, and so we did. The larger-than-normal family of 9 was about to be faced with the biggest hurdle to overcome in this lifetime. While we sent requested paperwork, made payments in the amounts we were told to, received denial after denial, we are now faced with a Sheriff Sale.

One wants to know how these corporate giants sleep at night?

As I said above we have a large family; 2 eighteen year old sons, 1 sixteen year old son, 1 sixteen year old daughter, 1 thirteen year old son, 1 ten year old daughter and 1 seven year old son. Not to mention, there is Loki (mastiff/boxer), Misty (collie), Molly May (rat terrier), Asher (black cat), and Francine, Jaws and Bell (three baby red-eared sliders) to have under our roof. We are not the small family that may be able to relocate homes easily without the loss of pet(s), sharing of rooms, or space available to live.

Currently, we have remodeled the duplex to a single family home. While there are plenty of projects to get to, we are happy. Everyone has their own bedrooms, we have two bathrooms, we have a fenced in yard for our pets, multiple levels of space and the largest Cottonwood tree you have ever seen.

As you can see, we need all of the help that we can get. We are not rich, wealthy or seeking stardom. We are merely trying to save the only thing that we share and that is our home.

Please help us to stop these mortgage giants from taking everything from us. We are the point where desperation has set in and we have tried everything they have asked and succeeded, yet, come March our home will be listed on the County Sheriff Sale. With your help, we may be able to save our home, our pet’s home and keep the only thing that remains the same, our love for each other in “our” home, together.

WE MUST STAY STRONG!!!!

All of you have to realize it's in OneWest's best interest just to foreclose on you. Loan Mod's just delays the process & they'll actually lose less if they foreclose on your home & in many instances like one user said they can resell your home & make a profit. Especially now since the market is just barely starting to see a glimmer of stabilizing & in some markets a subtle rebound! The fact of the matter is, being a mortgage banking employee myself and let me add a disclaimer that I'm not offering ANY LEGAL ADVICE here but in a few years there WILL be programs to address those who had to let their home go but kept the rest of their credit in tact. That's called a situational period of bad credit. This is the biggest financial "situational" period in history for the US after the Depression. There's too much money out there & too many investors waiting for America to get back into the lending swing. Like my user name says, "let'em have it...meaning the house" start over again, rent for 3-4 years, save your money & you'll be able to buy again. But more wisely this time.

Start to bombard Dell Inc with emails, add to their blogs. I love how founder Michael Dell used Dell Inc to make him look like the good guy by donating to Hait, but then OneWest Bank is foreclosing on Americans. Hit Dell Inc with all that you can. You can't have Dell Inc making you look like a saint while you are profiting on kicking Americans out of their home. See my new article

This OneEvil Bank made $128 billion the last quarter of 2009. Their sweetheart deal with the FDIC when they bought the failing IndyMac Bank allowed them to buy all our mortgages for .60 on the dollar. They have a loss share agreement with the FDIC wherein OneWest only takes about a 30% hit of a loss when they foreclose on our homes. OneWest still takes possession of our homes and kicks us out, gets your home and resales it. Whatever they get is pure profit for them.

I attended a protest outside of the corporate offices of OneWest in Pasadena, CA. We were a small group but a man named Tony Ebers who identified himself as the CEO claimed that OneWest modifies 1 in 4 loans??? That would be 25% of all their loans. I seriously doubt that unless they are modifying them UP rather than down.

This bank needs to be slapped and knocked off their high horse. However, their "investors" are people like George Soros, big contributor to Obama's Presidential campaign and Michael Dell the computer nerd. These "investors" already had a crap load of money before making this sweet deal with the Feds. so doubtful the limo libs will work out anything for us the Main Street people who are hurting the most in this Recession/Depression.

The Class Action suits need to start coming but rumor has it that OneWest Execs have contacted all the major Class Action Law Firms and persuaded them to NOT take any suits against their bank. And, with the connections OneWest has to the Obama Administration it's a good chance any suit filed against OneWest of any significant amount will not be awarded Class Action status.

This is truly OneEvil Bank!!

We have been fighting w/ IndyMac bank for 2 years and when OneWest Bank was created, we were never contacted by anyone. We have called and sent letter after letter, even certified letters and they have never responded. There is a class action lawsuit but for only $24 settlement. Has anyone tried to get them to settle for pennies on the dollar? They purchased all of our loans for pennies on the dollar, why were we not offered the same as the homeowners? I would be really interested to find out if anyone has been able to purchase their loan for pennies on the dollar. We are working with an attorney right now and that is going to be our question to him this next week.
We built our home and IndyMac never converted our loan from construction to a mortgage. I know that ours is a different situation but the outcome is still the same. They are liars and thieves.

Our nightmare began two years ago when my husbands income was drastically reduced. We built our house on my grandfathers land and have faithfully made payments until the economy down turn. We called right away to Indy Mac and were told they couldn't help us we weren't making enough money. NO KIDDING Finally they gave us a modification. We got a whole $100 off our monthly payment. Mind you this was after sending documents in over and over. Two weeks later we were sent a letter saying they sold out and our modification wasn't any good anymore. We tried to get a new mod but were denied because of our income. I have gone from a full time housewife to a full time emplyee. My husband works two jobs sometimes three so we can pay the utility bills. Thru hard work we are able to make a mortgage payment now but bank denies us. We have had one letter sent to us about foreclosure and nothing else. No public notice which our state requires. I am going to fight this to the end. We have four kids who want to stay in their home and dammit I am going to do everything I can for them.

I am a business contributor for AC...I have written articles regarding OneWest Bank..here are the links to my articles..I am currently following and documenting the experience of one borrower's loan mod nightmare..I will be writing one to two articles on Onewest bank/Indymac..

My advice..DO NOT DO ANYTHING WITH THIS BANK ON THE PHONE..all conversations must be documented through email. This bank is very dishonest and its employeess will tell you anything to get you off the phone. Find a contact email in the bank and do all emails through them only. It may be the only way to save your home.

OneWest Banks has the worst customer service ever. I called them and told them to move my CD to another one right when it was about to mature and they did. 2 weeks later, I called to find the rate and they said the CD automatically rolled over to the same old rate because I had not called during the grace period. I told them that I was told it was done. They said they didnt have a record of the call and they didnt see it in their system. I talked to manager and the sleazeballs still kept saying they had no record. THey said if I withdraw I would pay a $400 penalty. These people at OneWest Bank are greedy, have no integrity, dont care about customers. They just want to take your money every way they can. I hope they rot in hell.

same thingh I have been trying to get a loan modification for one year now and until last week they did not get all the doceumentes needed, ( I did send all the packages like they wanted) at least five times via fax
twice via mail with proof of delivery, and it was until last week that I got an answer:
Get counceling or short sale your home it's a shame how the banks get rescue with our tax money but we get no help,
every time I called I did have to explain my situation
over and over, seem like they did not care about Us.

A class-action lawsuit against OneWest for its bait and switch loan modification scam is currently pending in the US District Court of Maryland. Those interested in learning more should contact the Plaintiffs attorneys of Civil Justice Inc. Finally somebody wants to hold the servicers accountable.

My little boy was going through cancer treatment, and we fell behind in our loan. We tried to catch up, and they suggested a mod. This was in January 2009.

We paid, just as directed. We were told 3 months, but every month they were "backlogged"....we kept paying.

They were taken over by the FDIC, and we had a new "3 month" plan..which we paid for 10 more months...again, they were "backlogged."

In May 2009 we were denied, and told we had 2 months to "catch up"....and were told that the 18 months of payments didnt count as mortgage payments!!

we have sought help from every avenue, and have been told nobody can force them to modify for us.

this is unfair! We are so stressed out, I need someone to help me get this settled.

We have tried lawyers, US Senators, FDIC, OTS, HUD...and while everyone agrees we were wronged, nobody is able to help.
