Received modification paperwork stating payment to be received 12/01/2011. I made the payment, OWB accepted it and auctioned the home I've lived in since the 1980's anyway.
What does OWB say? Too bad, so sad.

Perhaps my being in compliance and current on my modification with One West Bank and the concurrent sale of my mortgage to Fannie Mae for $10 in Texas didn't sit right with the judge. It doesn't pass the smell test. My attorney Dubin Law / Frederick Arensmeyer successfully argued (1) Breach of contract, (2) cancellation under the Federal-Truth-in Lending Act (TILA) (3) unfair and deceptive acts and practices and (4) quiet title for wrongful foreclosure, to the judges satisfaction to allow our lawsuit to continue. No small feat when you are up against these huge government backed institutions.
This judge shows the courage, insight and compassion to allow David to face Goliath. So many have been denied their 5th amendment rights being stripped of their property never to have their day in court.
I wonder if the judge had seen this video with regard to the obscene deal One West struck with the FDIC. Some of the details are explained very well in this short video:

Thank you everyone who posted on this site and made light of the situation we're all in. I hope there is a BRIGHT light at the end of the tunnel for all of us that are trying to save our homes. I have found a forum site that is helping me tremendously regarding modification and others who have or are going through the process. Go to: www.loansafe.org. Check out the Forums. I have been trying to modify my parent's loan for over a year and a half now. Going to NACA as well as trying to do "in-house" modifications. They have rejected the loan at every turn. Citing documents weren't sent on time, income isn't sufficient (hence the need for Help!), same story as everyone I've read here and on other sites. I am determined to keep this home for my parents who have lived in it going on 11years. She has been disabled since 2007 and we have moved in to help with her health and all other aspects. I get what they are trying to do now, but I will stop them from foreclosing on the home.

@Sandra Rufolo - Don't be despaired! I know what you are going through and you're NOT alone. I'm in the same boat as yourself. They have been giving EVERYONE who owns a IMB/OWB loan the run around. They will continue to do so till they run you out of your home. Keep sending them information to modify, write to your congress person, write to their CEOs make them listen. Just don't give up. If worse comes to worse, keep the money you would have put into the mortgage, save that money and when they actually kick you out, use that money for good use.

My home entered foreclosure lastsummer. When all my efforts to get a loan modification led to nowhere, I finally borrowed from my 401(k) an emergency loan (another nightmare as I latered learned JP Morgan was in cahoots with IndyMac) to pay off the nearly $60,000 they said I owed them. I am now without a 401(k) savings and after a year, my home is sure to go into foreclosure again as my boyfriend, whose home he almost lost, is living with me and has been unable to procure work for nearly two years. The thought of once again going through this nightmare is leading me to thoughts of suicide.

Dont bother with the agents at indymac. Write certified letters to departments.That way you have documentation. These up front stooges IMB hires as agents are trained to pacify and lie and just pawn u off...America seems to have a very big awareness arising on this subject. AGs are digging Sec is looking and the Fed wont let themselves look bad so my guess is that everyone will start sueing each other before long. I would think twice about voting for Obama, I think he is lying to our faces and desperetly seeking re election by blowing smoke up the American peoples buttski's....Soros is probably cutting him in on the deal to keep justice away until IMB/One West cashes in on their sub prime terrorist attack.

Michael Dell of the computers, George Soros billionaire friend of Obama's and founder of moveOn.org (friend to 3rd World people but evil hater of American citizens) ALL are investors in OneWest. They all got together and paid pennies on the dollar to buy the failing IndyMac. Foreclosing on your home makes them $$. They take your home, the file a claim with the Feds (FDIC) get 80% compensation and then resale your home making a profit between the claim payment from the federal government and the proceeds from the sale of your home--all with purchasing the note on your home from IndyMac for .20 cents on the dollar...get the Picture??
Trying to find an attorney who can afford to go after a giant like OneEvil Bank backed by billionaire investors, is extremely difficult, that is why you have not seen lots of class action suits. Plus anyone with any potential of really slapping down OneEvil Bank gets bought out before their suit gains any publicity.

I have been fighting with the OneEvil bank for a couple of years. Whatever they tell you is to be suspected. Their Loan Escalation department is filled with incompetent liars. They strung me along with hopes of a loan modification after I sent and resent all docs to them 6 times (which each time they claimed to NEVER have received, a ploy they use to delay, delay) Finally, I received their generic denial letter which states in part "the investors do not believe you qualify for a loan modification"....after protesting in front of their corporate HQ, I was assigned a local rep from the corp offices to work with me on allegedly obtaining a permanent loan mod. She lied of course. I received a temporary stay of foreclosure and paid each month what i thought was a permanent fixed loan amount. It wasn't. That year put me further behind and in arrears.

One West/One EVIL bank increased my monthly payments from $2300 to a whopping $5200 with none of the payment going to principal!!!

When I contacted them and said " I thought we agreed to a permanent modification" ohhhh NO they said!

My problems did not start with buying too much house or into one I could not afford. Quite the opposite. What did happen is I missed a property tax payment due to losing my job. I was working with the tax assessor's office and was assured that I was a hardship case and i could make reduced payments monthly to the tax assessor until my employment position changed. When OneWest bought IndyMac, Onewest set about doing an aggressive audit of all their loans. The found my account, slapped me into a forced escrow--which was okay but what caused major problems in making my mortgage payments was in addition to the forced escrow, they added a mysterious "shortfall" of $23,000 and wanted me to pay that back in 12 months thus increasing my monthly mortgage by $2,000!! There was NO way to pay. I called and tried to work something out, like a longer pay back period and was told by OneWest " the only way we will work with you, is for you to stop paying your mortgage. You must be behind in order to obtain a loan modification" Of course that was all LIES!! These a-holes created a problem by being soooo uncooperative. I have never had a valid explanation as to why or what this mysterious "shortfall" of cash was in the forced placed escrow account--but whatever, it caused major problems. I am now in pre-foreclosure and to top it off, I don't think One West owns the note to my home and cannot legally foreclose!! I am too tired to fight at this point.

If you have a loan through Indymac bank then the only thing I can tell you is that you will lose your home to them eventually. My mom had a home for forty years and she borrowed through Indymac and she had payments twice the amount of her income and she hired good lawyers and nothing was done. When she passed away, I went through a service sponsored by the govt. and Indymac stalled the loan mod process by saying there were missing documents and then foreclosed on the house. Their whole intention is to take your house sooner or later. Best advice is get out from under Indymac if you can by finding another bank.

IndyMac Bank, You people are set up to steal from the American people. The sub prime mortgages you idiots pushed messed up the whole country. You robbed from the government, you lied about the quality of investments and stole county pensions in doing so. You avoided paying county fee's with your MERS conveinent for the Banks BS scheme. IndyMac is in violation of federal policy according to the MHA Handbook. They denied my request for loan modification while I was in an active Bankruptcy. No correspondence was sent to me or my attorney.

I faxed them Loan Modification paperwork and they received on 7/22. They denied on 7/26. Their reasons were the following: missing paperwork wasn't sent to the bankruptcy department and I was in active bankruptcy. Again no notice or corrispondence was sent to me or my attorney. They were waiting until my bankruptcy was discharged to proceed with sale of my property.

Indymac one west bank has screwed me oyer since 2009 on loan mod and hamp. They said I never appeared or a meeting that I never got paperwork or they said they never git papr work which they did because o was dealing with loss mitigation. I want to sue them. So how can I do it?

I agree with skyking1234 look up your loan on mers. I requested a copy of my note from onewest and it was stamped by new century title co. Stamped: claimed to be a true and correct copy of the original and the signature is so messed up it looks like Linda Green signed it(watch 60 min on loan fakes). New Century went bankrupt in 2008 so the copy they gave me is a copy of the original note. gettin a lawyer,a friend got 4 home deeds because of loans sold as stock. get mad and smart do what you can to keep your home.

We have been through everything everyone is saying and were offered a repayment plan, $26,000 to be paid 2 business days later. I don't trust them. They say they can still foreclose without telling us, which concerns me. No one will give a straight answer. Has anyone done this successfully?

Onewest/Indymac delayed our modification,constantly saying our paperwork was incomplete. We would send document after document, and it didn't matter. You never talk to the same person twice. They are crooks!!!!
They would return our mortage payments forcing us to become over 90 days late, with notice requesting certified funds....although we had never had a check returned for insuffient funds.
finally we had to file for bankruptcy protection in order to save our home. What we found through the bankruptcy experience....is there are so many people like us and many banks like Onewest, who have no interest in modifiying mortgages, they just wanted the tarp money.
Now we are under federal protection....they have to modify our mortgage - they were ordered by a federal court to do so. Good luck out there....we almost waited too long because we were afraid of bankruptcy....but it is helping us save our home.

Our house was foreclosed on, on July 27, 2011. We fought them for the last 2 years trying to get a loan modification but they did absolutly nothing! They just kept saying we need this paper, we need that paper! and all they were doing was dragging their heels so we would get foreclosed on we are very interested in a lawsuit right now if anyone knows of a class action law suit that is going on right now against ome/indymac I would really appreciate it! My dad built our home in 2001 the home had all of our blood, sweat and tears in it... He passed away in 2008 and we have been trying to save the one thing he loved most, His home! Indymac/one west are the biggest crooks on the planet! Everyone of the people who think that taking the homes of hard working Americans trying to pay their bills and make a living is ok should be in prison! I'm only 19 and I have been working since i was 15 after my dad died to help pay our mortgage because my mom wasn't able to pay all of it because it was too expensive! But someday I will get OUR home back for her! When indymac foreclosed on our house they thought they had heard the last of us... What they don't know is they aren't even close to being done with us! They will pay!!!
